AFTER a poor year in the tourist industry, Scottish hotels could find themselves further hit if they are excluded from a small business rate relief scheme which could knock up to 75% off business rate bills. Details of the plan are to be announced later this year by Jack McConnell, Scottish finance minister, but the all-party local government committee has already recommended the implementation of a “tapered” relief scheme, probably based on employers national insurance. Last week, Gerry Dowds, director of the Forum of Private Business Scotland, wrote to McConnell and Henry McLeish, minister for enterprise and lifelong learning, to raise the matter. Dowds says: “With a tapered scheme, a ceiling is unnecessary. It means small businesses occupying highly rated premises, like most Scottish hotels, will be excluded. A ceiling such as this would also create disincentives for companies wanting to grow into bigger premises which would not qualify for any relief.”

Snobbishness and condescension ooze from every sentence of Mr. Douthats essay, and his one-size-fits-all dismissal of the films screened at the American Film Renaissance festival (the festivals movies were often awful in fascinating ways, but they were awful nonetheless) strikes me as typical liberal shallowness. How could he make such a blanket statement if he had seen the excellent documentary Entertaining Vietnam, a film that has won best-documentary awards in multiple film festivals around the U.S.? Of what relevance could his opinion of what they look like be to the content of the films in the festival?

It joins the Co-operative Bank and a small, but growing number of organisations that believe they can influence the way corporate Britain behaves by withholding their money from companies involved in alcohol, tobacco, armaments, gambling and pornography. Say you are buying stock in Hanson, one of the biggest cigarette manufacturers in the country (it owns what used to be called Imperial Tobacco, maker of Players and Embassy). Its stock market value is about pounds 10bn. To have any significant effect on the company, you would have to pick up at least half a per cent of the company - that would cost you pounds 50m. The Methodists may well have access to funds on this scale. Presumably, they wont be buying Hanson shares. But would it not be making a stronger ethical statement if it did buy a slug of Hanson and started fighting from within? The Methodists would be one of the dozen biggest shareholders, and Hanson, famous for working “in its shareholders interests”, would have to sit up and listen to them rather than dismissing them as a bunch of ignorant do-gooders.

Scottish Highland Hotels shrugged off the shelving last week of rival Principal Hotels planned flotation. It is pressing ahead with its own market debut next month and yesterday signalled its confidence by sticking with the placing price of 125p a share it settled on in September. At the placing price, Scottish will be valued at pounds 30.4m, just 12.4 times post-tax earnings, making it one of the most cautiously priced issues. The company said it would have paid a full-year dividend of 3p, representing a gross yield of 3 per cent. The former fiefdom of the Fimmers family, which remains a sizeable shareholder, the company fell on hard times in the recession and management control was relinquished to the professional operations team who had previously reported to the family. Hamish Grossart was brought in as chairman. They transformed the company from a family plaything to a more focused business venture and since 1993, operating margins have risen from 21 per cent to a forecast of more than 30 per cent in the year ending tomorrow. Profits for the period just closing are estimated at not less than pounds 2.1m from sales of pounds 16.5m, up from the pounds 1.4m recorded last year before a one- off chunky exceptional gain that distorted the reported figure. Back in 1993, profits of only pounds 242,000 were made from sales of pounds 14.9m. When dealings start on 11 November, Scottish should get off to a healthy start. EDINBURGH, SCOTLAND — A hotel chef here has created a dessert that could stretch the boundaries of the term excess. The 1,000-calorie dessert is a deep-fried chocolate sandwich. According to a report in The Times of London, the sandwich is made by coating two slices of white bread with chocolate sauce, dipping them in batter and deep-frying them. The concoction then is covered in sugar and more chocolate sauce and served with vanilla ice cream. The sandwiches are delicious, she claimed. Last week, Gerry Dowds, director of the Forum of Private Business Scotland, wrote to McConnell and Henry McLeish, minister for enterprise and lifelong learning, to raise the matter. Dowds says: “With a tapered scheme, a ceiling is unnecessary. It means small businesses occupying highly rated premises, like most Scottish hotels, will be excluded. A ceiling such as this would also create disincentives for companies wanting to grow into bigger premises which would not qualify for any relief.”

The Methodist church has set up a company to manage an ethically correct portfolio. It joins the Co-operative Bank and a small, but growing number of organisations that believe they can influence the way corporate Britain behaves by withholding their money from companies involved in alcohol, tobacco, armaments, gambling and pornography. They call it “ethical” investing. Say you are buying stock in Hanson, one of the biggest cigarette manufacturers in the country (it owns what used to be called Imperial Tobacco, maker of Players and Embassy). Its stock market value is about pounds 10bn. To have any significant effect on the company, you would have to pick up at least half a per cent of the company - that would cost you pounds 50m. The Methodists may well have access to funds on this scale. Presumably, they wont be buying Hanson shares. But would it not be making a stronger ethical statement if it did buy a slug of Hanson and started fighting from within? The Methodists would be one of the dozen biggest shareholders, and Hanson, famous for working “in its shareholders interests”, would have to sit up and listen to them rather than dismissing them as a bunch of ignorant do-gooders.

Data for June and July show the first signs of softening in the construction sector. According to seasonally adjusted data, the value of construction put in place in July was approximately at the same level as in June and thus 7.4% lower than in May. In the five months to May, the value of construction put in place was 38.7% higher than a year ago; in June and July the difference narrowed to 16.7%. Employment in the construction sector continued to rise. In 2006, the number of workers employed in the construction sector was 7.5% higher than in the previous year. In the first seven months of 2007 it surged by 11%. The hiring of foreign workers has also been on the increase (see SEM 7/2007: 11). The number of workers rose particularly in building completion and general construction, similarly as last year. In terms of worker status, sole proprietors and their employees recorded higher growth rates. Increasingly many firms face difficulties in finding labour. According to business trends in construction, 51% of construction firms reported “a shortage of skilled labour” as a limiting factor to production. If answers are weighted by the number of employees, this share is even higher (58%) - the highest in five years (since these data have been available). The shortage of skilled workers became a significant limiting factor in the second half of 2006 (see graph), coinciding with the boom in construction activity in that period.

Scottish Highland Hotels shrugged off the shelving last week of rival Principal Hotels planned flotation. It is pressing ahead with its own market debut next month and yesterday signalled its confidence by sticking with the placing price of 125p a share it settled on in September. At the placing price, Scottish will be valued at pounds 30.4m, just 12.4 times post-tax earnings, making it one of the most cautiously priced issues. The company said it would have paid a full-year dividend of 3p, representing a gross yield of 3 per cent. The former fiefdom of the Fimmers family, which remains a sizeable shareholder, the company fell on hard times in the recession and management control was relinquished to the professional operations team who had previously reported to the family. Hamish Grossart was brought in as chairman. They transformed the company from a family plaything to a more focused business venture and since 1993, operating margins have risen from 21 per cent to a forecast of more than 30 per cent in the year ending tomorrow. Profits for the period just closing are estimated at not less than pounds 2.1m from sales of pounds 16.5m, up from the pounds 1.4m recorded last year before a one- off chunky exceptional gain that distorted the reported figure. Back in 1993, profits of only pounds 242,000 were made from sales of pounds 14.9m. When dealings start on 11 November, Scottish should get off to a healthy start. When their press release lands on an editors desk, the editor sees a hot little local story. Even if the railroad did try to comment, how can you keep on top of situations over tens of thousands of miles and respond promptly enough to meet an editors deadline? Taint easy, and the lawyers know it. An old dodge among lawyers is to harp constantly about irrelevant points to make a witness look bad. For example, a friend witnessed a crime. On the witness stand, the defendants lawyer pelted her with questions about exactly how many feet she was away from the road, the sidewalk, the nearest stop light and on and on. When she didnt have the distance down to feet and inches, he bellowed that she didnt even know where she was that day, so why should a jury believe her? By focusing on totally irrelevant or only slightly relevant points, the lawyer distracts from the real issues. And if lawyers can get away with that in a courtroom, just think how far theyre willing to stretch in a press release.

This insight, this backward vision, first came to me as a young man, a boy really, as some weirdness of the airwaves slipped through the static of our new Motorola with a discussion of beauty between Robert Penn Warren and Paul Weiss at Yale College. We were in Kansas eating barbecue-flavored potato chips and waiting for Father Knows Best to float up through the snow of rural TV in 1963. I felt transported, stunned. Here were two grown men discussing beauty seriously and with dignity as if they and the topic were as normal as normal topics of discussion between men, such as soybean prices or why the commodities market was a suckers game or Oklahoma football or Gimpy Neiderland almost dying from his hemorrhoid operation. They were discussing beauty and tossing around allusions to Plato and Aristotle and someone named Pater, and they might be homosexuals. That would be a natural conclusion, of course, since here were two grown men talking about beauty instead of scratching their crotches and cursing the goddamned government trying to run everybodys business. Not a beautiful thing, that. The government. Not beautiful, though a man would not use that word. One time my Uncle Ross from California called my moms Sunday dinner centerpiece lovely, and my father left the room, clearly troubled by the word lovely, coupled probably with the very idea of California and the fact that my Uncle Ross liked to tap-dance. The Commerce Department reported Tuesday that builders started construction on new homes and apartments at a seasonally adjusted annual rate of 1.84 million units in March, down from 2.23 million units in February. “This is a bit of a shocker,” said David Seiders, chief economist for the National Association of Home Builders. “But I dont think this represents a fundamental downshift in the housing market. There were special factors behind it.”
Colorado Springs-area home construction continued its blistering pace in the first quarter, although one economist fears an oversupply could drive down prices in the next few years. Single-family home building permits totaled 1,392 from January through March — a 20.2 percent jump from the same period last year, according to figures released Friday by the Pikes Peak Regional Building Department. The number of permits this year puts Colorado Springs and El Paso County on pace to shatter the record of 5,059 single-family permits, set only last year.

Real estate practice is a broad and widely defined area of the law. In a pristine sense it deals with the esoteric subject of real property law and titles. In practice the subject matter handled by real property lawyers is much broader. Many of the areas of law within real estate practice are areas of specialty themselves. Real estate lawyers examine and evaluate real property titles, handle real estate sales, purchases and other transactions, foreclose mortgages, represent developers and contractors in drafting and negotiating development and construction agreements, handle real estate financing, structure and draft the governing documents for planned developments such as condominiums, serve as counsel to community and condominium associations, draft and negotiate leases, litigate title, boundary, and other land disputes, and advise clients respecting zoning and land: use matters. The examination of real estate titles requires knowledge of corporations and other forms of business organization, wills, trusts and estates, and a practitioner handling transactions must understand contractual, business, and tax subjects as well. The subjects that are tested on the certification exam attest to this diversity. They are title issues; real estate finance; environmental and land use; condominiums and homeowner associations; landlord tenant; closings; sellers, buyers, brokers, and title insurers; real property litigation; taxation of entities and other tax issues; and ethics. Some hold an impression that at least some aspects of the real estate practice are not challenging, that the practice is increasingly title company, form, and paralegal driven, and that when business is light any lawyer with a good paralegal can Ado real estate closings. This impression is not accurate. As with any area of practice, successfully representing clients in real estate matters requires knowledge, skill, and experience. Significant ethical risks prohibit criminal defense lawyers from arranging or posting bond for clients in all but the rarest of cases, but there may be tactical reasons for them to do so and circumstances where they may. But the committee also suggested that it would be rare to obtain genuine and voluntary informed consent from a client experiencing stress, anxiety and other pressures from confinement and the conditions of incarceration.
